But it will also pursue discrimination claims based on race, ethnicity, age, disability, and other protected categories. The number of equal pay lawsuits filed by the EEOC has declined over the past few years. However, this is most likely because the EEOC has filed many fewer lawsuits generally during that time period. Many commentators believe that was due to the changes in EEOC leadership wrought by the Trump administration. Many expect the pace of filings to increase significantly over the next few years as that leadership changes hands again under the Biden administration.
